All visitors who use this website (smodstr.com) and make purchases are deemed to have accepted the following terms in advance:

The web pages on our site and all associated pages are owned and operated by GYM WATCH (hereinafter referred to as 'Company'). You ('User') acknowledge that you are subject to the following terms while using the services offered on the site, that you have the authority to enter into a contract according to the laws applicable to you, and that you are over 18 years of age.

1. RESPONSIBILITIES

  • Right to Change:The company reserves the right to change watch models, spare parts, modification labor fees, and prices at any time.

  • Service Continuity:The company guarantees that the user will benefit from the products and modification services ordered without interruption, except in the case of technical failures.

  • Reverse Engineering:The user agrees not to reverse engineer the site's software or design, nor to copy the source codes.

  • Content and Ethics:The user may not share content that is contrary to public morals, misleading, offensive, or violates copyright in comments, reviews, or contact forms.

2. INTELLECTUAL PROPERTY RIGHTS

  • 2.1. The GYM WATCH logo, custom-designed watch visuals, product photos, technical texts, and methods found on the site are the property of the company. Unauthorized use is prohibited.

  • 2.2.Modification designs and content displayed on the site may not be shared on another platform or copied for commercial purposes without written permission.

3. CONFIDENTIAL INFORMATION AND DATA SECURITY

  • 3.1. Definition:The company does not share "Confidential Information" such as name, surname, address, and contact information with third parties.

  • 3.2. Purpose of Use:The user consents to the use of their contact information for marketing activities such as campaigns, new watch models, or discount announcements.

  • 3.3. Legal Exception:Information may only be shared in accordance with the legal request of official authorities, as required by legislation.

4. WARRANTY AND SERVICE LIMIT

  • Nature of the Product:The watches offered by GYM WATCH are personalized (modified) products based on original watches. The company provides these services "as is."

  • Disclaimer:To the extent permitted by applicable laws, the Company does not accept responsibility for damages arising from user errors, exceeding waterproof limits (use beyond the specified ATM values), or impacts caused by the user.

5. REGISTRATION AND SECURITY

The user is obliged to provide accurate and up-to-date information to ensure the smooth operation of order and shipping processes. The security of the account and password is entirely the user's responsibility.

6. FORCE MAJEURE

In cases considered as "Force Majeure" such as natural disasters, global disruptions in logistics networks, unforeseen delays in customs processes, or technical infrastructure failures, the parties' obligations are suspended.

7. CHANGES TO THE AGREEMENT

The Company may update the terms of use or sales policy at any time. The updated terms become effective as soon as they are published on the site.

8. EVIDENCE AGREEMENT AND COMPETENT COURT

  • Evidence:In disputes that may arise between the parties, the Company's digital records, email correspondence, and system records are accepted as conclusive evidence in accordance with the Law on Civil Procedure No. 6100.

  • Jurisdiction: In the resolution of any disputes arising from the implementation of this agreement, the Courts and Enforcement Offices of Istanbul (Central) are authorized.
